Law and development scholars in the instrumentalist mold have certainly been aware that, their model notwithstanding, there is no perfect correspondence between law "on the books" and law "in action." A law is enacted with the objective, say, of reforming a land tenure system thought to be inimical to development; but nothing changes. In this connection, Allott speaks of "phantom legislation," that is, "the passing of laws which do not have, and most probably cannot have, the desired effect."
