1982年畢業(yè)于蘭州大學(xué)外語系，獲文學(xué)學(xué)士學(xué)位，同年在西北政法學(xué)院任教。1985年5月至1986年9月在澳大利亞國(guó)立大學(xué)思想史研究所做訪問學(xué)者。1988年在美國(guó)哥倫比亞大學(xué)做訪問學(xué)者，1991年取得美國(guó)哈佛大學(xué)法學(xué)碩士學(xué)位，1995年取得哈佛大學(xué)法學(xué)博士學(xué)位。1995年到1998年在貝克·麥肯思國(guó)際律師事務(wù)所工作，1998年3月至6月為北京大學(xué)訪問教授，1998年8月任哈佛大學(xué)法學(xué)院高級(jí)研究員、講師，2000年始受聘于香港中文大學(xué)政治與行政學(xué)系。2002年起受聘為西北政法大學(xué)特聘教授。自2012年1月起，被美國(guó)康奈爾大學(xué)法學(xué)院聘為the Anthony W. and Lulu C. Wang 講席教授。2013年11月起受聘為杭州師范大學(xué)法學(xué)院教授。
先后師從澳大利亞國(guó)立大學(xué)卡門卡教授、悉尼大學(xué)鄭汝純教授，美國(guó)哥倫比亞大學(xué)愛德華教授、哈佛大學(xué)安守廉、格倫登、米諾等教授。主要研究方向?yàn)榉ɡ韺W(xué)、法律與社會(huì)理論、法律文化、香港憲政、司法改革。曾應(yīng)吉林大學(xué)、中國(guó)政法大學(xué)、山東大學(xué)威海分校之邀，以當(dāng)代西方法理學(xué)為主題講學(xué)，為國(guó)內(nèi)法理學(xué)學(xué)者、學(xué)生講授當(dāng)代西方法律理論。
